DISTANCE SALES AGREEMENT

1. PARTIES

This Distance Sales Agreement has been concluded electronically between the parties specified below, within the framework of the terms and conditions outlined below.

By accepting this agreement, the BUYER acknowledges that if they approve the product or products subject to the order, they will be obliged to pay the order amount, shipping fees if any, taxes, and other additional charges, and that they have been informed about this matter.

2. DEFINITIONS

In the application and interpretation of this agreement, the following terms shall have the meanings indicated opposite them:

MINISTRY: The Ministry of Commerce,
LAW: Law No. 6502 on Consumer Protection,
REGULATION: The Regulation on Distance Contracts,
SELLER: The company that offers goods to the consumer within the scope of its commercial or professional activities,
BUYER: The person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
SITE: The website https://chinatrendturkiye.com belonging to the SELLER,
ORDERER: The person who requests products or services via the SELLER's website,
PARTIES: The SELLER and the BUYER,
AGREEMENT: This Distance Sales Agreement,
GOOD / PRODUCT: Refers to movable property subject to purchase.

3. SUBJECT MATTER

The subject of this agreement is to determine the rights and obligations of the parties under Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, regarding the sale, delivery, return, and right of withdrawal processes for products ordered electronically by the BUYER via the SELLER's website https://chinatrendturkiye.com.

7. INFORMATION ON THE PRODUCT(S) SUBJECT TO THE AGREEMENT

7.1 Basic characteristics of the product

The type, model, color, size, quantity, sale price, payment method, delivery address, and other order details of the product or products subject to the agreement consist of the information available on the product page, shopping cart, and payment screen on the website at the moment the BUYER completes the order.

7.2 Prices

The prices listed and advertised on the Site are sales prices. Advertised prices and campaigns are valid until updated or changed. Time-limited campaigns are valid until the specified period ends.

7.3 Taxes and payments

The sales price of the products, including all taxes, is shown on the payment screen at the moment the order is completed.

The product description, quantity, unit price, subtotal, shipping cost, and total payment amount are specified in the order summary and payment screen.

The invoice is issued in accordance with the applicable legislation and is delivered electronically or with the order to the customer where necessary.

9. GENERAL PROVISIONS

9.1 The BUYER acknowledges that they have read and understood the basic characteristics, sales price, payment method, delivery information, return and right of withdrawal conditions of the product subject to the agreement on the SELLER's website, and that they have given the necessary confirmation electronically.

9.2 The BUYER acknowledges that they have reviewed the product descriptions, price, delivery time, shipping fee, and return conditions before placing an order.

9.3 The SELLER is obliged to send the products subject to the order in accordance with the specifications stated in the order, in sound and complete condition.

9.4 China Trend Turkey may have two different sales models:

- In-stock products within Turkey: Products in stock are generally shipped within 2-5 business days.
- Pre-order products: Products sourced from China. For these products, the estimated delivery time may vary between 18-24 days on average.

9.5 For pre-order products, delivery time may vary due to the sourcing process, shipping intensity, customs procedures, public holidays, weather conditions, or delays caused by shipping companies.

9.6 The SELLER shall inform the BUYER if the product subject to the order cannot be supplied or if delivery becomes impossible. In this case, the product price may be refunded to the BUYER, or an equivalent different product option may be offered with the BUYER's approval.

9.7 The BUYER is responsible for any delivery problems that may arise due to the BUYER providing incorrect or incomplete address, phone, or contact information during the order.

9.8 Upon delivery, the shipping package should be checked for damage. In case of damaged packages, a report should be requested from the cargo officer, and the situation should be reported to the SELLER.

10. DELIVERY

10.1 Orders are sent to the delivery address specified by the BUYER during the order.

10.2 For in-stock products within Turkey, the delivery time is generally 2-5 business days.

10.3 For pre-order products, the estimated delivery time is 18-24 days on average.

10.4 Delivery time may vary depending on the product sourcing process, shipping company, customs procedures, public holidays, force majeure, and operational intensity.

10.5 The process will be carried out without exceeding the legal delivery period of 30 days. If delivery cannot be made within this period, the BUYER will be informed.

11. RIGHT OF WITHDRAWAL

11.1 The BUYER may exercise the right of withdrawal without giving any reason within 14 days from the date of receiving the product.

11.2 To exercise the right of withdrawal, the BUYER must notify the SELLER via e-mail or WhatsApp within the 14-day period.

11.3 For the product to be returned under the right of withdrawal, it must be unused, unworn, undamaged, and its tag and packaging must be intact.

11.4 The product to be returned must be sent to the SELLER with its invoice or order information.

11.5 After the product reaches the SELLER, its compliance with the return conditions is checked. If the return is approved, the product price is refunded to the BUYER within the legal period.

12. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal may not be exercised for the following products:

- Products custom-made according to the BUYER's wishes or personal needs
- Used, worn, or damaged products
- Products with removed tags
- Products with damaged packaging
- Products unsuitable for return due to hygiene reasons
- Underwear bottoms
- Makeup and cosmetic products
- Disposable products
- Products that are not suitable for return by their nature

13. RETURN AND EXCHANGE CONDITIONS

13.1 In case of wrong, missing, or defective product delivery, the BUYER may contact the SELLER to request a return or exchange.

13.2 If the defective or wrong product delivery is due to the SELLER, the shipping cost during the return or exchange process shall be borne by the SELLER.

13.3 If the BUYER requests a return due to not liking the product, changing their mind, or for arbitrary reasons, the return shipping fee may be borne by the BUYER.

13.4 Exchange transactions depend on stock availability. If the product to be exchanged is out of stock, the BUYER may be offered a refund or a different product option.

14. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults on payment when using a credit card, they agree that they will be liable to the bank under the credit card agreement between them and the card-issuing bank.

15. FORCE MAJEURE

Natural disasters, war, epidemics, strikes, transportation obstacles, customs procedures, delays caused by shipping companies, decisions of official authorities, and similar situations beyond the SELLER's control are considered force majeure.

In such cases, the SELLER will inform the BUYER and provide the necessary guidance regarding the order process.

16. COMPETENT COURT

In disputes arising from this agreement, complaints and objections will be made to the Consumer Arbitration Committees or Consumer Courts in the place of residence of the consumer or where the consumer transaction was made.

17. EFFECTIVENESS

The BUYER shall be deemed to have accepted all the terms of this agreement when they complete the payment for an order placed through the https://chinatrendturkiye.com website.
